Service Agreement
By scheduling services with Total Heating & Cooling, Inc., you agree to these terms and conditions. Our services are provided subject to the following terms:
- All work will be performed in a professional and workmanlike manner
- We will use quality materials and equipment appropriate for each job
- Services will be performed by licensed and insured technicians
- We reserve the right to refuse service if conditions are unsafe
Pricing and Payment
- We charge by the job, not by the hour
- All estimates are provided free of charge
- Final pricing will be confirmed before work begins
- Payment is due upon completion of work unless other arrangements are made
- We accept cash, check, and major credit cards
- A service charge may apply to returned checks
- Past due accounts may be subject to collection fees and interest
Warranties and Guarantees
We stand behind our work with comprehensive warranties:
- Labor warranty: 1 year on most repairs and installations
- Parts warranty: As provided by manufacturer
- Equipment warranty: As provided by manufacturer
- Emergency repairs: 90-day warranty on labor
- Warranty does not cover damage due to misuse or normal wear
- Warranty work must be performed by Total Heating & Cooling
Liability and Insurance
- We carry comprehensive general liability and workers' compensation insurance
- Our liability is limited to the cost of services provided
- We are not responsible for pre-existing conditions or code violations
- Customer is responsible for providing safe working conditions
- We are not liable for indirect or consequential damages
- Claims must be reported within 30 days of service completion
Scheduling and Cancellation
- Service appointments are scheduled based on availability
- We provide estimated arrival times, not exact appointment times
- Emergency services are prioritized over routine appointments
- 24-hour notice is required for appointment cancellations
- A service charge may apply for same-day cancellations
- Weather conditions may affect scheduling
Customer Responsibilities
- Provide accurate information about the service needed
- Ensure safe access to work areas
- Remove personal items from work areas
- Provide adequate lighting and electrical power
- Secure pets during service visits
- Be present or designate an authorized representative
- Report any concerns immediately
Dispute Resolution
In the event of a dispute, we encourage direct communication to resolve issues. If necessary:
- Disputes will be governed by Kansas state law
- Venue for legal proceedings will be Sedgwick County, Kansas
- Mediation may be required before litigation
- Customer waives right to jury trial for disputes under $10,000
